Terms of Service

Please read these Terms of Service carefully before using sabahay.ph. By creating an account or using our platform, you agree to be bound by these terms. If you do not agree, please do not use our services.

1. Platform Description

sabahay.ph is an online marketplace and information platform for Philippine real estate. We provide tools that allow property owners, licensed real estate brokers, salespersons, and developers (collectively, “Sellers”) to list properties for sale, rent, or pre-selling, and allow prospective buyers and renters (“Buyers”) to search, discover, save, and inquire about those properties.

sabahay.ph is a marketplace and technology platform, not a licensed real estate broker or agent. We do not own, manage, or control any listed property. We do not represent buyers or sellers in any real estate transaction. Any transaction arising from use of our platform is solely between the buyer and seller involved.

2. Eligibility

To create an account and use sabahay.ph, you must:

  • Be at least 18 years old, or the age of majority in your jurisdiction.
  • Have the legal capacity to enter into binding contracts under Philippine law.
  • Provide accurate, truthful, and current information when registering your account and creating listings.
  • Not have been previously suspended or banned from sabahay.ph for violations of these Terms.

By registering, you represent and warrant that you meet all of the above eligibility requirements. Accounts created by or for individuals who do not meet these requirements may be suspended or terminated.

3. Listing Rules and Responsibilities

By submitting a property listing on sabahay.ph, you agree to all of the following:

3.1 Accuracy and Truthfulness

All listing information — including property type, price, size, location, amenities, photos, and availability — must be accurate, current, and not misleading. You must promptly update or remove listings when a property is sold, rented, or no longer available.

3.2 Authorization to List

You may only list a property if you are: (a) the registered owner of the property; (b) a licensed real estate broker, salesperson, or agent duly authorized by the owner to list the property; or (c) an accredited developer with authority to sell or pre-sell the units. By listing a property, you represent that you have the legal right and authorization to do so.

3.3 Photos and Media

All photos and media submitted must accurately represent the property being listed. You must own or have the right to use all images you upload. Digitally manipulated images that misrepresent the property are prohibited.

3.4 Listing Review

sabahay.ph reserves the right to review, approve, reject, or remove any listing at its sole discretion, including listings that violate these Terms, appear fraudulent, or do not meet our quality standards.

4. Prohibited Content and Conduct

The following are strictly prohibited on sabahay.ph and may result in immediate account suspension, listing removal, and referral to appropriate authorities:

  • Fake or fraudulent listings: Listing properties that do not exist, are not available, or that you do not have authority to sell or rent.
  • Price manipulation: Artificially inflating or misrepresenting property prices; posting a price with intent to change it materially upon contact with buyers.
  • Duplicate listings: Posting the same property multiple times to gain search visibility advantage.
  • Impersonation: Representing yourself as another person, licensed professional, or organization without authorization.
  • Harassment or abuse: Using our messaging or inquiry system to send spam, unsolicited commercial messages, or harassing communications to other users.
  • Illegal listings: Listing properties with unresolved encumbrances, court orders, or legal defects that you have not disclosed, or properties whose sale or lease is prohibited by law.
  • Data scraping: Using automated tools, bots, or scrapers to extract data from sabahay.ph without our prior written consent.
  • Platform interference:Attempting to circumvent security measures, disrupt platform functionality, or gain unauthorized access to other users' accounts.

5. Intellectual Property

5.1 sabahay.ph Intellectual Property

The sabahay.ph name, logo, platform design, software, code, and all original content created by us are owned by or licensed to sabahay.ph and are protected by Philippine and international intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from our intellectual property without our prior written permission.

5.2 User Content License

By submitting listing content, photos, descriptions, or other materials to sabahay.ph, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, distribute, and adapt your content for the purposes of operating and promoting our platform. You retain ownership of all content you submit.

5.3 Third-Party Content

You must not upload content that infringes the intellectual property rights of any third party. If we receive a valid complaint that content you posted infringes on another party's rights, we reserve the right to remove it.

6. Disclaimer and Limitation of Liability

6.1 Platform is a Marketplace

sabahay.ph provides a technology platform to connect buyers and sellers. We do not act as a real estate broker, agent, or advisor. We do not verify the legal title, condition, or fitness of any property listed on our platform, and we make no representations or warranties regarding the accuracy of any listing content submitted by users.

6.2 No Warranty

The platform is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.

6.3 Limitation of Liability

To the maximum extent permitted by Philippine law, sabahay.ph and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including damages resulting from transactions between users, reliance on listing information, or unauthorized access to your account.

6.4 User Responsibility

Users are solely responsible for conducting their own due diligence on any property, verifying ownership documents, titles, and encumbrances, and engaging licensed professionals (lawyers, licensed brokers) as needed before entering into any real estate transaction.

7. Dispute Resolution

7.1 Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law principles.

7.2 Between Users

sabahay.ph is not a party to disputes between buyers and sellers. We encourage users to resolve disputes amicably. For issues involving fraudulent listings or scams, users should report these to us at legal@sabahay.ph and to the relevant Philippine authorities including the Philippine National Police or the Department of Trade and Industry.

7.3 Disputes with sabahay.ph

Any dispute, controversy, or claim arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the appropriate courts of the Philippines, with venue in Metro Manila unless otherwise required by law.

8. Account Suspension and Termination

8.1 By sabahay.ph

We reserve the right to suspend or terminate your account and access to the platform at any time, with or without notice, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent activity, or pose a risk to the platform or other users. In cases of serious violations, we may immediately deactivate your account without prior warning.

8.2 By You

You may close your account at any time through your dashboard settings. Upon account closure, your listings will be removed and your personal data will be deleted in accordance with our Privacy Policy, subject to legal retention requirements.

8.3 Effect of Termination

Upon termination, your right to access and use the platform ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, and dispute resolution — shall survive.

9. Modifications to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes via email or a prominent notice on the platform. Your continued use of sabahay.ph after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the platform and may close your account.
